ACCC Enforcement

The ACCC has issued a $19,800 penalty to Luxottica Franchising Australia (OPSM and Laubman & Pank) for failing to keep its Franchise Disclosure Register up to date.

The issue was straightforward. The register was not updated by May 2025, leaving the profile marked as “out of date”. The ACCC has been clear that this is not just a box-ticking exercise. The register is a key transparency tool relied on by prospective franchisees and their advisers when assessing a network.

There are two takeaways franchisors should not overlook.

First, the ACCC now both administers and enforces the register, and it is actively reviewing compliance.

Second, enforcement is not limited to smaller operators. Large and well-resourced franchise systems are firmly within scope.

Maintaining an up-to-date Franchise Disclosure Register is a core obligation under the Franchising Code. It requires annual review and prompt updates for any material changes.

If your register has not been reviewed recently, it is worth addressing now before the regulator does.
